Nice reasoned argument,  but minus any of the facts in regard to the current judicial system,  in other words a lot of assumptions. So here is the short treatment -

There is no such thing as equal treatment under the law,  it is a fantasy.  In fact,  there is no such thing as the “rule of law,”  there is just the law of rule.  The idea of a rule of law is a dangerous elite idea,  all the so-called rule of law is the extension of the divine right of kings,  there is no law in the sense of legal that acts like a law of nature.  Not that there is not plenty of law for you and I,  there is just none for the moneyed elite – and much more for the poor and the weak who are smashed beneath its gavel daily. You have the same moneyed elite behind what is called the rule of law,  it is just no longer a public office of a king.

You have “laws” which are propagated to maintain an oppressive system,  a assurance of the wealth of the few as opposed to the many, and crime for the most part is the output of the systemic nightmare.  The crimes are borne by a reaction to the system,  there is not “law and order” as you conceive of it,  there is just “order and law” – order not as opposed to chaos,  but order in the sense of the grid iron place everyone is supposed to have in society – class preservation,  not order as opposed to mayhem.  Law is merely the handmaiden of the order,  making sure that everything remains in the unrighteous “balance.”

Have you looked at the prison system?  Do you know that by the year 2100 that the powers that be estimate 33,000,000 to be incarcerated?  The prison system is a perpetuation of class,  only the poor and people of color for the most part are among the ranks of the prison population.  as an example – the “new” Jim Crow.  Actually racism is merely the thin veneer of class warfare,  just like religion is used,  just like gender is used,  etc.

Some of the links might be outdated on my blog (notinhisname,  in the sense of third party),  because some was written in 2007,  but there is no change in our current condition and the truth posted there.

Actually…the original concept of ‘law’ existing as a codified agreement…emerged from people’s discontent with the ruling castes and their demand that the ‘rules’ not be made up on whims depending on who was in charge at the moment. All written laws in the western half of the world emerged from the Hammurabic Code…which influenced everything that came after. Basically…it wasn’t government that demanded laws come into being…although they were happy to pervert them at every opportunity…it was people seeking a barrier between themselves and the despotic power of early monarchs and priests. So I can’t accept your dismissal of the concept…even if I agree completely about how we’ve let it slide into the hands of maniacs, crooks and thugs. What makes systems of law and jurisprudence work…is participation and awareness. Two things that we’ve slipped away from out of sheer laziness. Once you have those two firmly in place…you can watch the watchers, deploy the checks and balances, and at least develop a survivable system that isn’t a horror to behold…basically…the opposite of what we’re stuck with right now.

you’re a troll, which is worthy of dismissal in and of itself, but that you actively troll (your last 10 or so comments) on a site you’ve never posted on before solely to assert baseless acusations and ad hominems is pretty…well..sick?

I champion involvement and vigilance…precisely because you are correct about the direction things turn…with money and entrenched power ultimately winnowing away the protections against same, usually as soon as the ink is dry on the paper.

You do the authors of the Constitution a bit of disservice tho…and when we say ‘real history’ its a bit of a loaded vague term depending on who says it and what they know of the authors and their writings. I didn’t just read the Const…I read the writings of the authors…and the books that inspired them…and so on back through most of the enlightenment era.

Side note: old Thom J the slaveowning white moneyed elite…included in the first draft of the Const. provisions that would have ended slavery then and there. Not exactly the act of a secret imperialist who discreetly favored the enslavement of men of the concepts of egalitarian liberty and fraternity. And what kept that version from becoming the law of the land? Respect for the principles of democratic process. The objections were too great for consensus, and to force the issue would have violated the core concept on which the country was founded…and so a great horror was tolerated here longer than most other places. (In part because the US refused to entertain compensation schemes which would have paid people a portion of the ‘investment’ they lost. Much of Europe found ways to quietly pressure slavery out of favor…successfully.)

Note also that no small number of the other authors never intended for the initial Bill of Rights to be infringed upon. Much of it is ’self evident’…and should be clear to all…except that we’ve bred a generation so ignorant and fearful that they can be easily gulled into anything if the TV tells it to them with a serious voice. The concept of checks and balances was intended to prevent the various factions from being swept by one single agenda…precisely to avoid the frenzied imperialism and nationalism and religious mania that swept the whole of Europe and most of Africa into chaos for hundreds of years.

Naturally…we did away with most of those protections at certain periods…and restored some of them during others. You mention the starvation and taking up of arms…and these are accurate things that have happened in multiple eras…(although slowly fading in regularity after the era of TV took hold…not a coincidence in my book.)

You can paraphrase Madison’s sentiment…but he’s most oft quoted by neo-cons looking to bend one comment to shore up their wholly unconstitutional beliefs. I’d paraphrase Franklin…”Those who would surrender liberty for safety will find themselves with neither.” Or a quote whose origins escape me at the moment “Banking establishments are more dangerous than standing armies.” There are hundreds of jewels like these for every soundbite Newt Gingrich cobbles together to explain his amoral existence.

To sum up…its great to mention a few things wrong with some of those original authors, but its very unjust to deliberately ignore the heaps of contradictory and remarkably broad minded ideals they held…ideals that often did not serve their personal best interest, but were precious enough to them to enshrine when they could have grasped after kingship.

So to answer that paragraph…I don’t think we need a ‘tweak’ or a ‘little adjustment’…and its a gross mischaracterization to make sound as if I think thats the cure. We need a massive overhaul…from the ground up…and it will take what I mentioned at the start…a people who have accepted that they will have to exercise themselves and their minds…with involvement…and vigilance. We don’t need a few reforms…and we also don’t need ’systemlessness’…technically we had that briefly. They called it the frontier and eventually people got sick of being shot at…and drafted…you guessed it…laws. Rebuilding the laws would be the smallest part of what we need…its rebuilding our collective understanding of our role in all this…thats the part that will make or break us. Like the miners and laborers who wound up in shooting wars with robber barons’ hired troops…it may take people experiencing the real tyranny of ‘free markets’ before they wake up to what citizenship means…and what it demands from them.

How can you “forge” something that doesn’t exist?

When I say “real history” I mean all of the contingencies and specifically the benefit,  cui bono.  You might as well know that I have come to the conclusion,  after much deliberation and study that for the most part,  governments are nothing but a franchise of the elite.  The documents of the foundation can be interpreted only by the actions encouraged by the ruling class,  and if you even read my short link below (Empire As American As Apple Pie),  it displays that old adage that actions talk and bs (words) walk.

You walk away with a Declaration that just served to inflame the passions of the people in the service of the few,  all the way to Shay’s Rebellion.  You have a Constitution which meant to isolate the people from the sphere of government,  and the ruse of “representation” becomes the food of fools (not the most perfect form of government).  You have the foundation of the Constitution being the strong central government for trade and a stronger government to put down insurrections,  all in all that the wealthy wanted a strong government to protect their interests,  and that sold to a wealthy elite through bonds (for the most part) to whom they would answer (in other words,  slavery was not the only blemish,  and there are many more than I mention). 

In the founding fathers you have very accomplished men,  make no mistake – but those who would use the people to their designs.  You have a Thomas Jefferson who called the people brute beasts,  and a disheveled and broken man at the end of his life that only wants to be remembered for founding a university (outside of inflaming the masses that “all men were created equal”  except for the damnable savages who were the object of genocide).  The accomplishment of great men is to be persuasive spoken and written orators while bending the wills of men to their own design. Checks and balances has been a farce from the beginning,  one has but to look at how it has been repeatedly tossed after the documents inauguration,  like the treaties which were made with the indigenous people. As far as the founders not opting for kingship,  it is much easier to hide among a group.

I am glad you think it needs a massive overhaul,  and I would opt for nothing less than direct participation (not representative farce). Of course I would add the destruction of the entire engine,  but I will not elaborate.  The frontier,  just as a reminder for you is a bit of washed history,  why don’t you try looking at giving millions of acres to the railroads for a start and what that entailed – and the response it received from the people.  We are already at a larger gap between the rich and poor than the robber baron days – which should prove to you how the opponents have honed their “skills” at thievery,  with an inverted tyranny which many do not recognize.  Free markets are just a buzz word for global monopolies,  and the present activity in the world is just another phase of Imperialism.    

I can’t disagree that govt inherently becomes a bastion of the wealthy and powerful. Its another self evident truth. Power acts to entrench and preserve itself…and with a few exceptions here and there…thats all its ever done.

But to take a slightly different tack and bring perspective back into line…the concept of central govt strong enough to be effective in crisis has both good and bad sides…not just bad. Historically, if we look at examples of strong central govt gone horribly awry…we get Chile, Nazi Germany, the Soviet Union etc. To bring perspective back…lets not forget that when central govt is weak and ineffectual in the other extreme…we get Haiti, Somalia, large swaths of Latin America, with small temporary juntas that bubble and burst, vanish and are replaced by the next junta. (Side note: contrary to popular belief…the modern US loves such chaos…its good for business…and dictators and despots are easier and cheaper to bribe than entire elected bodies. We hate to admit it…but America hates actual democracies.)

End point…absence of solid central govt sounds good…to people who haven’t lived in such a state. The trick is that its hard work for people to manage it day by day and stay involved. We keep hunting for a way out that involves less effort and fewer hassles. There are plenty of ways like that…almost all of them ultimately involve a state of affairs that others have already endured and found wanting.

I lack the room to go into minute detail, same as you, because this isn’t the place to recycle entire lectures and whole articles and long stretches of history, but I am keenly aware of the era of railroad expansion/ genocide / wage slavery. The horror of it…and of the eras that came after…are in part what readied a generation to fight for basic rights for workers and a tax system that acknowledge reality…ushering in a brief renaissance that fueled unbelievable gains in quality of life. (Of course…after about 80 years…there’s almost no one left alive who can tell stories about fellow miners shot to death by hired union breakers…we’ve forgotten how hard those few rights were to achieve…and how much they cost. Looks like we’ll have to learn it all over again.)

In the end, I think we’re separated only by slight difference in the level of our cynicism. I feel the same distrust of both excessive govt power and absent govt power…and I put my faith in finding balance somewhere between the two…an echo of the few brief moments where we got it right for awhile. You seem to have an unyielding belief that any form of organized authority must turn evil…and so they should be avoided in the first place. You aren’t wrong about the natural drift toward corruption…you’re dead right (also on the term ‘free markets’…which is just a fancy name for Ayn Rand-ian gangster anarchy…a thugs paradise, a workers nightmare)…but the constant fight to patrol and purge a system of its ills is what I feel it takes to gain the few benefits of govt…and those benefits may be hard to define…until we visit someplace without them. You sound like an ass!  A 3yr old understands what money is and the fact that it can purchase things like candy, but a 3yr old doesn’t know there is no such thing as a 1 million dollar bill.  It’s obvious this man doesn’t understand there is no such thing as a 1 million dollar bill! A normal adult criminal would not go into a store and try to spend a 1 million dollar bill!  Take race out of the equation and use your common sense! 

That has been my point all along,  it is the shuffle off to the prison industrial complex.  Someone who obviously does not have the capacity to understand the bogus nature of a million dollar bill should not be prosecuted.  However,  this judicial system does not care about that,  it gets money per each body it incarcerates.  Many prisons have been privatized,  or they started as private contracted entities,  and literally they make money  and are counted as profitable on the stock exchange by the amount of bodies in their prisons. North Carolina where this occurred has several private institutions,  with many more in the works to be built,  its all about money (this actually is true about both private and public prisons) –

You guys calling for psychiatric care don’t realize that coerced psychiatric “care” is at least as much a threat to one’s autonomy as prison is. Rapes happen in psychiatric care, too. And then we force a bunch of people to take a bunch of chemicals (meds) they probably don’t want. I would call that torture. At least in a prison you serve your sentence and they can’t hold you beyond that. Hell, half the time you get free before your sentence is even complete. In a “hospital” people can’t leave until a series of “experts” decide, arbitrary and subjectively, that someone is “fit” to leave. This individual would surely be free of prison before he is let loose from psychiatric care. He’d probably only get a couple of months lock up, but he’d be in “care” for years, and for what? Because he annoyed several people by trying to buy shit with a billion dollar bill? Give me a break. He has shown no behavior to be considered a threat to himself or to society. An annoyance? Sure. A threat? Fuck off.

What about Bernake? He’s buying shit with counter-fitted trillion dollar bills.

He  worked all day at Goldman Sachs to earn that money, and now to be
told it’s worthless will probably send him over the edge and we’ll end
up paying higher taxes to provide him with welfare because he can’t work
due to his post traumatic stress disorder associated with this horrible
crime.  Better we should take him out and let our modern
judge-jury-executioner police put him to death for this crime against
humanity, they can pepper-spray him to death.  But it would probably
help to subject him to water-boarding and sleep deprivation  for a few
months first to be sure he didn’t intend to use the change expected to
finance his terrorist associates. He’s a mean shrewd one you can tell by
